Patrick de Warren — Fine Art Photography & Collection Documentation

1. Our Approach

Shooting Art Work provides professional fine art reproduction photography and collection documentation services for private collectors, artists, galleries, museums, foundations, estates, and other institutions.

Every collection and project is unique. Our aim is to provide accurate, high-quality photographic documentation while respecting the client’s priorities, privacy, and intended use of the images.

These terms establish the general conditions of our services. Specific project requirements, deliverables, fees, usage rights, and any special arrangements will be confirmed in the relevant proposal, estimate, or written agreement.

2. Confidentiality and Discretion

We understand the importance of discretion when working with private collections, valuable artworks, residences, and estates.

Client information, collection inventories, valuations, addresses, and other confidential materials will be treated with care and will not knowingly be disclosed to third parties, except as necessary to perform the agreed services, with the client’s authorization, or as required by law.

We do not publish private collection inventories, identifying information, or images of a client’s collection without the appropriate authorization.

Additional confidentiality requirements can be agreed upon in writing before work begins.

3. Portfolio and Website Use

Photography is also a visual practice, and selected projects help demonstrate the quality and expertise of our work to future clients.

Where appropriate, Shooting Art Work may request permission to feature a selection of completed photographs in its professional portfolio, on its website, in presentations, or in other promotional materials.

Your privacy and the integrity of your collection always come first.

Portfolio use is subject to the following principles:

* Permission first: Images will be featured only after obtaining the client’s written authorization and, where necessary, permission from the relevant artist, copyright holder, estate, or other rights holder.
* Selective presentation: Only mutually approved images will be considered, with appropriate captions and credits where applicable.
* No sensitive information: Collection inventories, insurance documents, valuations, private addresses, security details, and other confidential information will not be published.
* Respect for restrictions: Any confidentiality agreement or project-specific restriction takes precedence over general portfolio intentions.

Clients may request that a project remain entirely confidential. We will respect this arrangement as agreed in writing.

Where a client prefers not to authorize portfolio use, this will not affect the professional quality of the service provided.

4. Copyright and Usage Rights

Unless otherwise agreed in writing, Patrick de Warren retains copyright in the original photographs he creates, subject to applicable law and any third-party rights.

The client receives permission to use the delivered images for the purposes specified in the accepted proposal or written agreement. Depending on the project, these may include collection records, insurance documentation, archival records, publications, exhibitions, websites, or other agreed uses.

Any additional use outside the agreed scope can be discussed and authorized separately.

Copyright in the original artwork remains with its respective artist or rights holder. Permission to photograph or reproduce an artwork does not automatically grant rights to reproduce the artwork itself.

Where appropriate, image credits may be requested for published uses.

5. Proposals, Fees and Payment

Each project is quoted according to its scope, location, technical requirements, number and nature of artworks, image processing, delivery requirements, and intended use.

The accepted proposal will specify the agreed fees, deliverables, schedule, payment terms, and any applicable travel, accommodation, handling, or additional production expenses.

A deposit may be required to secure dates or cover advance expenses. Payment milestones will be agreed upon before work begins.

Additional work or expenses outside the agreed scope will be discussed with the client and authorized before being incurred, except where immediate action is reasonably necessary and prior approval is impracticable.

6. Scheduling, Cancellation and Postponement

We understand that collection projects can involve changing schedules, access arrangements, transportation, conservation requirements, and the availability of third parties.

If a project must be postponed or cancelled, we will work with the client to find a reasonable solution whenever possible.

Any cancellation charges will reflect the agreed terms, work already completed, non-recoverable expenses, and any reserved production time that cannot reasonably be reassigned.

The applicable arrangements will be confirmed in the proposal or booking agreement.

7. Image Delivery and File Retention

Images will be delivered in the formats, resolution, and timeframe agreed upon for the project.

Clients are encouraged to maintain their own secure backups of delivered files. Long-term archiving and future file retrieval are not included unless specifically agreed in writing.

Any image review, revision, or additional processing requirements will be established in the project agreement.

8. Care of Artworks and Access to Premises

The client or its authorized representative is responsible for arranging appropriate access to the collection and informing us of any relevant handling, installation, conservation, or security requirements.

Shooting Art Work will exercise reasonable professional care while carrying out the assignment. Specialist art handling, installation, packing, or moving services will be arranged separately when required.

Any particular insurance requirements or responsibilities relating to the artworks, premises, equipment, or personnel should be discussed and agreed upon before the assignment.

9. Professional Responsibilities

We will make reasonable professional efforts to deliver work consistent with the agreed brief and technical specifications.

If circumstances beyond our reasonable control affect the schedule or delivery, we will communicate with the client and seek an appropriate solution.

Any limitations of liability, insurance arrangements, or responsibilities for loss or damage will be governed by the applicable law and the specific written agreement for the project.

10. Project-Specific Agreements

Certain assignments, including museum projects, institutional commissions, insurance inventories, private estates, and highly confidential collections, may require additional terms.

Where a signed proposal, confidentiality agreement, or project-specific contract establishes different conditions, those agreed conditions will govern the relevant aspects of the assignment.

11. Applicable Law and Dispute Resolution

The applicable law and the appropriate process for resolving disputes will be determined in accordance with the relevant contract and applicable legal requirements.

We believe that clear communication and a professional, constructive approach are the best starting points for resolving any concerns.

12. Contact

For questions about these terms or to discuss the requirements of a particular collection, please contact Patrick de Warren through Shooting Art Work.

Every project begins with a conversation about the collection, the client’s objectives, and the appropriate level of discretion.
